This Agreement is entered into between LikeToBuy (Pty) Ltd referred to as “LikeToBuy” and the undersigned “Vendor” for the purpose of onboarding the Vendor onto our e-commerce platform mosselbayonline.co.za.  LikeToBuy’s Primary role will be that of a service provider, facilitating the sales transaction between the vendor and the customer, and offering courier services (cold-chain fresh produce) as well as last-mile delivery to your doorstep, process.
By registering as a Vendor, you agree to comply with the Consumer Protection Act, 2008 (CPA) and the following Terms and Conditions defined as:

Definitions and Key Terms

  • CDA: Cosmetics and Disinfectants Act, 1972
  • Cookie: A Small amount of data generated by a website and saved by our web browser. It is used to identify your browser, provide analytics, and remember information about you, such as your language preference or login information.
  • Company: When this terms mention “Company”, “we”, “us”, or “our”, it refers to LikeToBuy, LikeToBuy is responsible for your information under this Terms & Conditions.
  • LikeToBuy Country/ Location: Where LikeToBuy (Pty) Ltd or the owners/founders of LikeToBuy, Mosselbayonline, Gardenrouteonline, and are based, in  South Africa.
  • CPA: Consumer Protection Act, 2008.
  • Customer: A person or entity that buys from a listed Vendor on LikeToBuy.
  • Device: Any internet connection device, such as a phone, tablet, Private Computer, or any other device that can be used to visit LikeToBuy and use the services.
  • Services: Refers to the services provided by LikeToBuy which may include the use of its platform, handling of vendor items, packaging, bar-coding and labeling, as well as the collecting and delivering of goods.
  • Third-party service: Refers to advertisers, contest sponsors, promotional and marketing partners, and others who provide our content or whose products or services we think may interest you.
  • Website: URL accessing the LikeToBuy database.
  • User /Vendor: A person or entity that is registered with LikeToBuy/ mosselbayonline.co.za to use the Services by listing a product or a service.

LikeToBuy Terms & Conditions

By assessing and placing a product or service, or buying online from LikeToBuy/ mosselbayonline.co.za website, you (user / vendor) confirm that you are in agreement with and bound by the terms of service contained in the Terms & Condition outlined below. These terms apply to the entire website and any email or other type of communication between you and the company.

Our company provides complete transparency into what is being set when the user visits our site and how it’s being used. Any violation attempt to the usage of the website is set out in these Terms and Conditions.

Under no circumstances shall our team be liable for any direct, indirect, special, incidental, or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use the materials on this site, even if our team or an authorized representative has been advised of the possibility of such damages. If your use of materials from this site results in the need for servicing, repair, or correction of equipment or data, you assume any costs thereof.

We will not be responsible for any outcome that may occur during the course of usage of our resources. We reserve the right to change the resource usage policy in any moment.

License

LikeToBuy grants the user a revocable, non-exclusive, non-transferable, limited license to make use of our mosselbayonline.co.za site strictly in accordance with the terms of this agreement.

These Terms and Conditions are a contract between the user/ vendor (referred to as “you”, “your” and LikeToBuy (referred to in these Terms & Conditions as “LikeToBuy”, “us”, “we” or “our”), the web provider of mosselbayonline.co.za website and the services accessible from the LikeToBuy website (which are collectively referred to in these Terms & Conditions as the “LikeToBuy service”).

The user/ vendor agrees to be bound by these Terms & Conditions. If the user does not agree to these Terms & Conditions, the services of mosselbayonline.co.za will not be made available to the user. In these Terms & Conditions, the user refers both to “you” as an individual and to the “entity” you represent. If the user violates any of these Terms & Conditions, our company reserves the right to cancel your account or block access to your account without notice.

The Vendor/ User is granted access to the LikeToBuy e-commerce platform to list and sell products/ services to customers.

The Vendor/ User acknowledges that LikeToBuy operates as a facilitator of sales, logistics, and communications, not as the direct seller of Vendor products.

Restrictions

Except for the allowed mosselbayonline.co.za site access permissions given, the user agrees not to, and will not permit others to:

  • License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit LikeToBuy site, or make the platform available to any third party.
  • Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of LikeToBuy site.
  • Remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of or its affiliates, parties, suppliers, or the licensors of the LikeToBuy site.

Vendor Responsibilities

Marketplace Disclosure – Each Vendor will be clearly identified on the LikeToBuy platform. Customers must clearly see vendors name product details, and delivery conditions before purchase.

Product Information – Vendor must provide accurate and truthful product descriptions, images, pricing, and stock availability. All prices must include vat. Misrepresentation of goods is strictly prohibited under the CPA act.

Product Quality & Safety – Vendor warrants that all goods supplied meet minimum quality, safety, and labeling standards as required by South African law. Vendor assumes full liability for defective or unsafe goods.

Perishable Goods – Vendor must disclose expiry or best-before dates clearly. Perishables must be supplied in a condition fit for consumption at the time of delivery. Vendor acknowledges that perishable goods cannot be returned unless spoiled/damaged at delivery.

Refunds & Returns – Vendor must comply with LikeToBuy’s centralized refund process, including the CPA’s 7-day “cooling-off” period for non-perishables. Refunds must be honored promptly for defective, damaged, or misrepresented goods. Customers receive refunds through the same payment channel, within set timelines.

LikeToBuy Responsibilities

To provide vendors with platform access, logistics support, and vendor communications tools.

To ensure that the delivery of goods follows CPA requirements, including proper handling of perishables.

To facilitate customer complaints, refunds, and redress through a structured dispute resolution process.

Customer Protection & Redress

Vendors must cooperate in resolving customer complaints submitted via VoIP helplines, Email support, or the Online dispute portal.

If a complaint is not resolved within 48 hours by the Vendor, LikeToBuy will supply buyer with direct contact details to Vendor to resolve the matter. Vendors accept that unresolved disputes may be escalated to the National Consumer Commission.|
Vendors accept that there account can be frozen to continue business on the LikeToBuy platform if disputes is not resolved. Such a decision will be for LikeToBuy’s discretion.

Compliance & Liability

Vendors must comply with: The Consumer Protection Act, 2008 (CPA), The Foodstuffs, Cosmetics and Disinfectants Act, 1972 (for perishables), and all applicable labeling, packaging, and health regulations.

Vendor Liability: The Vendor assumes full responsibility for product safety, compliance, and customer claims relating to defective goods.

LikeToBuy Liability: Limited to logistics, facilitation, and ensuring compliance structures.

Insurance: Vendors must maintain product liability insurance for high-risk goods (especially perishables).

Unless negligence can be proven, our company is not responsible for any damage or loss due to improper packaging by the user /vendor during our handling or transporting of goods.

Our company is not liable for delays of delivery caused by weather, traffic, or third-party disruptions. Maximum liability for loss or damage is limited to R1000.

Payments

  • By registering, you agree to pay all applicable fees and charges to your account for the services rendered. These services include the commission structure of 15% (unless stated otherwise), which is calculated into the system. The website, developed by LikeToBuy, is programmed to automatically calculate a 15% commission fee for all items listed and sold through the platform. Users providing services via LikeToBuy (platform: mosselbayonline.co.za), as well as those involved in high-value sales, such as property transactions or vehicle sales, may be granted special pricing and permissions.
  • Costs will be charged for collecting goods from vendors to our local depot as per agreement if requested from Vendor.
  • Unless otherwise indicated, the user/ vendor must provide us with valid Banking details or Bitpay details.
  • By providing us with your Banking details associated payment information, you agree to and give us permission to authorize and verify your information immediately, and subsequently invoice your account for all fees and charges due to us, and that no additional notice or consent is required. The user/ vendor agrees to immediately notify us of any change in your billing address or the debit/ credit card used for payment hereunder.
  • Subject to the prior agreement with the user/ vendor, we retain the right to modify the previously agreed commission fee.
  • LikeToBuy utilizes a variety of payment platforms, including Payfast (South Africa), PayPal and Yoco (International POS and online payment solutions), and Bitpay, a decentralized cryptocurrency and innovative peer-to-peer payment network.
  • The user will only be permitted to have access to the website dashboard after approval is given from the website management and commission fees have been agreed upon.
  • Any attorney fees, court costs, or other costs incurred in collection of delinquent undisputed amounts shall be the responsibility of and paid by the user. The user will be responsible for any third-party fees that may incur due to the use of our services.

POPIA Compliance

1. Collection of Personal Information
In using this website and related services, you acknowledge and agree that we may collect, store, and process personal information, including but not limited to your name, contact details, delivery addresses, payment information, and any information provided during registration, transactions, or customer support. Such information will only be collected where it is lawful, necessary, and relevant to provide services on this marketplace platform.

2. Purpose of Processing
Personal information is processed strictly for the following purposes:

  • To facilitate transactions between buyers and sellers on the marketplace.

  • To provide customer support, delivery, and order updates.

  • To communicate service updates, notices, and marketing (where you have opted in).

  • To comply with legal, tax, or regulatory obligations.

3. Consent and Lawful Basis
By continuing to use this website, you consent to the collection and processing of your personal information as described in these terms. You may withdraw your consent at any time by notifying us in writing. Such withdrawal may affect the services we can provide.

4. Information Sharing
We will not sell or distribute your personal information to third parties without your consent, except where required by law, regulation, or court order, or where it is necessary to fulfill our contractual obligations (e.g., providing details to vendors, couriers, or payment processors involved in completing your order).

5. Security Safeguards
We have implemented reasonable technical and organizational security measures to protect personal information against loss, misuse, unauthorized access, alteration, or disclosure. Despite these safeguards, we cannot guarantee absolute data security, and you use the site at your own risk.

6. User Rights
In accordance with the POPIA Act, you have the right to:

  • Access the personal information we hold about you.

  • Request correction, deletion, or restriction of your personal data.

  • Object to the processing of your information for direct marketing.

  • Lodge a complaint with the Information Regulator of South Africa.

7. Retention of Information
Personal information will only be retained for as long as necessary to fulfill the purposes stated above or as required by law.

8. Cross-Border Data Transfer
Where services require personal information to be transferred outside South Africa (for example, international shipping or cloud storage), we will ensure that adequate protection is in place in line with POPIA requirements.

We may amend or update this POPIA compliance clause from time to time. Updates will be effective once posted on the website, and continued use of the marketplace constitutes acceptance of such changes.

Termination of Agreement

LikeToBuy reserves the right to suspend or terminate a vendor’s account if:

  • Vendor fails to comply with CPA regulations.
  • Vendor receives repeated verified complaints.
  • Vendor misrepresents or sells unsafe products.
  • Vendor not in compliance with the Terms & Conditions set out by LikeToBuy.

This agreement shall remain in effect until terminated by the user or LikeToBuy (platform: mosselbayonline.co.za) management, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.

Termination of this Agreement will not limit any of LikeToBuy (platform: mosselbayonline.co.za) rights at law or in equity in case of breach by the user/ vendor during the term of this Agreement of any of the users’ obligations under the present Agreement.

Indemnification

The user/ vendor agrees to indemnify and hold LikeToBuy/ mosselbayonline.co.za and its subsidiaries, affiliates, officers, employees, agents, partners, and licensors (if any) harmless from any claim or demand, including reasonable attorney’s fees, due to or arising out of your:

(a) use of mosselbayonline.co.za.

(b) violation of this Agreement or any law or regulation.

(c) violation of any third party.

Disclaimer

LikeToBuy/ mosselbayonline.co.za will not be held responsible for any content, code or any other imprecision. LikeToBuy/ mosselbayonline.co.za does not provide warranties or guarantees.

In no event shall LikeToBuy/ mosselbayonline.co.za be liable for any special, direct, indirect, consequential, or incidental damages or any damages whatsoever, whether in an action of contract, negligence or other offence, arising out of or in connection with the use of the Products rendered or the Service or the contents of the Service nor due to any legal dispute.
This includes any damages, harm or legal responsibilities for any products delivered by courier services to the client.

Typographical Errors

In the event of a product and/or service which is listed at an incorrect price or with incorrect information due to typographical error, or misrepresenting a product, LikeToBuy/ mosselbayonline.co.za will not be held responsible for the sale and LikeToBuy/ mosselbayonline.co.za shall have the right to refuse or cancel any such order whether or not the order has been confirmed.
Such mistakes will be recognized as an error, and a refund will be initiated for the listed selling price.

Notice of Dispute

In the event of a dispute, the user/ vendor or LikeToBuy/ mosselbayonline.co.za must give the other a Notice of Dispute, which is a written statement that sets forth the name, address, and contact information of the party giving it, the facts giving rise to the dispute, and the relief requested. Any notice of dispute must be mailed to: info@liketobuy.co.za
LikeToBuy is a service provider, and such a dispute will be referred to the Vendor for attribution.

Commission Fees

15% Commission fees will be calculated by the system as per stated store sales value (unless specified differently between LikeToBuy/ mosselbayonline.co.za management and the vendor).

Packaging and Delivery

Fragile items must be declared and may incur additional packaging requirements that may incur cost. Hazardous or prohibited items will not be accepted for delivery. Certain items may be restricted due to legal or safety reasons.

Deliveries will be made to the address provided by the client. If the recipient is unavailable, re-delivery may incur additional charges.

Vendors agree to use LikeToBuy’s integrated logistics network, including depots, hubs, motorbikes, vans, trucks, and cold chain trailers. A fee will be charged to Vendors for collecting items at their location.

Vendors delivering perishables must comply with cold chain protocols enforced by Law. LikeToBuy will comply to all cold chain protocols as set out by the CPA, 2008 & CDA, 1972.

Promotions

The product user of mosselbayonline.co.za, in accordance with LikeToBuy management, may include, contests, promotions or other activities as agreed upon to attract online sales. The vendor is responsible and agree to abide by, and comply with all promotions that was advertised. The 15% commission fees will still apply for all promotions advertised. Additional terms and Conditions may apply to purchases of goods or services on or through the Services, and which terms and conditions will be made part of this Agreement by reference.

Changes to Services & Policies

LikeToBuy/ mosselbayonline.co.za may change our Service and Policies, and we may need to make changes to these Terms & Conditions so that they accurately reflect our Service and Policies. If mosselbayonline.co.za management decide to change these Terms & Conditions, we will notify the user/ vendor and post those changes on this page, and/or update the Terms & Conditions modification date below. The user may review the changes (14 days) before they go into effect. If the user/ vendor continues to use the Service, the user/ vendor will be bound by the updated Terms & Conditions.

Submission and Privacy

In the event that the user /vendor submit or post any ideas, creative suggestions, designs, photographs, information, advertisements, data or proposals, including ideas for new or improved products, services, features, technologies or promotions, the user /vendor ideas will be treated as confidential.

No Warranties

mosselbayonline.co.za Services is provided to the user “AS IS” and “AS AVAILABLE” and with any faults and defects without warranty of any kind. mosselbayonline.co.za Provides no warranty or makes no representation of any kind that we will meet your requirements, sales, achieve any intended results, be compatible or work with any other software, websites, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Agreement & Acceptance

By acknowledging this Agreement, the Vendor confirms that they:

  • Have read and understood the LikeToBuy Vendor Terms & Conditions.
  • Agree to comply with the Consumer Protection Act and all applicable laws.
  • Accept that LikeToBuy reserves the right to enforce compliance and protect customer rights.

This agreement constitutes the entire agreement between the Vendor and LikeToBuy/ mosselbayonline.co.za and supersedes all prior and contemporaneous written or oral agreements.  These terms are governed by the laws of South Africa.
